Zerene, Inc. – Terms and Conditions

Welcome to Zerene. These Terms and Conditions (“Terms”) govern your access to and use of the Zerene mobile application (“App”), website at https://zerenelife.com (“Website”), and related products and services, including the Zerene mouthguard and impression kit (“Product”), operated by Zerene, Inc., a Delaware corporation (“Zerene,” “we,” “our,” or “us”).   By using any part of the Services, you agree to these Terms. If you do not agree, do not use the Services. 

 1. ELIGIBILITY
You must be at least 18 years old to use the App or Website. By using our services, you represent and warrant that you are at least 18 years of age and legally able to enter into a binding contract.  

 2. PRODUCT USE WARNINGS AND SAFETY PRECAUTIONS
Do NOT use Zerene products if: 

– You are under 18 years of age.
– You have loose teeth or teeth that wiggle.
– You wear dentures, braces, or other dental appliances, including permanent retainers or dental implants.
– You have severe temporomandibular joint (TMJ) pain or jaw clicking.
– You experience severe tooth, jaw, or facial pain.
– You intend to use the product for more than three months without consulting your dentist.

Ask a dentist before use if you:

– Have serious breathing or respiratory conditions.
– Have oral sores, bleeding gums, or gum disease.
– Have untreated cavities, loose fillings, or caps.
– Have difficulty chewing or pain in the jaw, teeth, or face.
– Have any major underlying medical conditions that could be affected by the use of an oral appliance.

Stop use and contact a dentist if:

– You experience oral soreness, bleeding, irritation, or discomfort.
– You develop worse jaw pain, earaches, headaches, neck stiffness, or clicking joints.
– Symptoms persist after one month of use.
– The product causes breathing issues, gagging, choking, or feels uncomfortable.
– You experience a change in bite that lasts more than a few minutes after removal.

Keep Zerene out of reach of children and pets.
 

 3. CAUTION: Dental Impressions
The included dental impression kit is designed solely for the custom fit of the Zerene mouthguard. It is not a substitute for professional dental services or diagnostics.
You agree to:

– Follow all instructions carefully.
– Not use the kit if you have active dental concerns or recent dental procedures.
– Discontinue use and consult a dentist if you experience any pain, discomfort, or unexpected effects. 

 4. MEDICAL DISCLAIMER
Zerene is not a licensed medical provider and the App and Website are not intended to diagnose, treat, or cure any condition.  The Zerene technology is not FDA cleared, and information provided through the App is for informational purposes only and should not be considered medical advice. Always consult with a qualified healthcare provider regarding any medical condition or concern.
 

 5. USER ACCOUNT AND CONDUCT
To access certain features of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate and complete information during the registration process and to update such information as necessary.
 

 6. DATA COLLECTION AND PRIVACY
By using the App, you acknowledge and agree that Zerene collects data such as sleep patterns and clenching frequency via the mouthguard device. This data may be used to provide personalized insights and improve the functionality of the App. For more information about how we collect, store, and use personal data, please refer to our Privacy Policy.
 

 7. PURCHASES AND RETURN POLICY
The mouthguard device may be purchased through our Website. All sales are subject to our Return Policy and any applicable product-specific terms. We use third-party payment processors and are not responsible for errors or security breaches on those platforms.
 

 8. INTELLECTUAL PROPERTY
All content, features, and functionality on the App and Website, including but not limited to text, graphics, logos, images, and software, are the intellectual property of Zerene or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
 

 9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Zerene shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the App or Website, even if we have been advised of the possibility of such damages.
 

 10. GOVERNING LAW
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
 

 11. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Effective Date” above or by providing other appropriate notice. Your continued use of the App or Website following such changes constitutes your acceptance of the revised Terms.
 

 12. TECHNICAL REQUIREMENTS
To use the Zerene mobile application and access its features, you must have:
A compatible smartphone:

– Apple iOS version 15.5 or later
– Android OS version 7.0 or later
– Reliable access to the internet or a wireless data connection.  Failure to meet these technical requirements may result in limited functionality or inability to use the App.
